These Terms and Conditions ("Terms") govern your access to and use of the websites, applications, and services (collectively, the "Service") operated by Puckly ("we," "us," "our"). By accessing or using the Service, you agree to be bound by these Terms.

The Service is available at puckly.ca, app.puckly.ca, and related subdomains.
You must be at least 13 years of age (or the minimum age in your jurisdiction) to use the Service. By creating an account, you represent that you meet this requirement and that all registration information you provide is truthful and accurate.
You may create an account using Google Sign-In or other methods we make available. You are responsible for maintaining the confidentiality of your account credentials.
You agree to notify us immediately at support@puckly.ca if you become aware of any unauthorized use of your account. We are not liable for losses arising from unauthorized use of your account.
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion, with or without notice.
Puckly offers free and paid subscription tiers. Paid plans are billed monthly or annually as selected at the time of purchase.
All payments are processed by Stripe. By subscribing, you agree to Stripe's terms of service. We do not store your full payment card information.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods unless required by applicable law.
We may change subscription pricing at any time. We will provide at least 30 days' notice before any price increase takes effect for existing subscribers.

The Service, including its design, code, algorithms (including the Market Price Index), branding, logos, text, graphics, and all other content created by Puckly, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written consent.
You retain ownership of any content you submit through the Service (e.g., portfolio entries, alert configurations). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store that content solely for the purpose of operating and improving the Service.
If you provide suggestions, ideas, or feedback about the Service, you agree that we may use such feedback without restriction or compensation.
Pricing and product data displayed in the Service is aggregated from publicly available sources. We do not guarantee the accuracy, completeness, or timeliness of third-party data. Prices shown are for informational purposes only and may not reflect real-time pricing.
MPI values are calculated using our proprietary algorithm from verified sales data. MPI values are estimates of market value and should not be relied upon as guarantees of actual sale prices or investment advice.
The AI assistant feature provides informational responses based on available data. AI-generated content may contain inaccuracies. You should verify any information before making purchasing or investment decisions.
The Service may contain links to third-party websites (e.g., retailer stores, eBay, auction houses). We are not responsible for the content, privacy practices, or terms of any third-party sites.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
Nothing in the Service constitutes financial, investment, or trading advice. Price data, MPI values, trend information, and AI-generated analysis are for informational purposes only. You are solely responsible for your purchasing and collecting decisions.
We do not guarantee uninterrupted or error-free access to the Service. We may modify, suspend, or discontinue any feature at any time without notice.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUCKLY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR CAD $100, WHICHEVER IS GREATER.
You agree to indemnify and hold harmless Puckly and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any dispute arising from these Terms or the Service shall be resolved in the courts located in Calgary, Alberta, Canada.
We may update these Terms at any time. If changes are material, we will provide notice (e.g., in-app banner or email) and update the "Effective date" above. Continued use of the Service after changes constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Puckly regarding the Service and supersede any prior agreements.
